PRIVACY POLICY

Fitness by Tara, operated by Tara Russo ("Fitness by Tara," "we," "us," or "our"), respects the privacy of our clients and is committed to handling personal information responsibly.
This Privacy Policy explains the types of information that may be collected in connection with Fitness by Tara's personal training and fitness services, why that information is collected, how it may be used, and circumstances in which it may be shared.
This Privacy Policy applies to information provided directly to Fitness by Tara and information provided through the Fitness by Tara application powered by FitBudd ("FitBudd").
1. INFORMATION WE MAY COLLECT
Depending upon the services you use and the information you choose to provide, Fitness by Tara may collect information including:
- Name
- Email address
- Telephone number
- Date of birth and age
- Emergency contact information
- Height and weight
- Fitness goals
- Exercise and training history
- Lifestyle and activity information
- Information regarding injuries, physical limitations, symptoms, health conditions, medications, medical restrictions, and other information relevant to safe participation in exercise
- Information regarding previous or current physical therapy or rehabilitation
- Measurements and fitness assessment information
- Progress information
- Photographs or progress photographs you choose to provide
- Communications between you and Fitness by Tara
- Scheduling and appointment information
- Purchase and transaction information
- Information submitted through questionnaires, check-ins, assessments, forms, or other features used in connection with Training Services
- Technical or device information that may be collected through FitBudd or other technology providers used to deliver services
You are responsible for ensuring that information you provide is accurate to the best of your knowledge.
2. HEALTH & FITNESS INFORMATION
Because Fitness by Tara provides personal training services, clients may voluntarily provide health and fitness information relevant to safe exercise programming.
This information may include injuries, pain, physical limitations, surgeries, medical conditions, medications, healthcare-provider recommendations, exercise restrictions, balance concerns, and other information relevant to your participation in Training Services.
Fitness by Tara uses this information for purposes such as evaluating exercise considerations, modifying workouts, determining whether additional information or medical clearance may be appropriate, and providing individualized fitness services.
Fitness by Tara is a personal training business and is not a healthcare provider or medical practice.
Fitness by Tara is generally not a "covered entity" under the federal Health Insurance Portability and Accountability Act ("HIPAA"). Accordingly, information you provide directly to Fitness by Tara generally is not protected by HIPAA in the same manner as information maintained by a physician, hospital, health plan, or other HIPAA-covered entity.
Fitness by Tara nevertheless intends to handle client health and fitness information responsibly and limit its use to legitimate business and training purposes.
3. HOW WE USE YOUR INFORMATION
Information collected may be used to:
- Establish and maintain your client account
- Communicate with you
- Schedule and manage appointments
- Provide and personalize Training Services
- Develop and modify exercise programming
- Review your fitness goals, progress, and training history
- Evaluate information relevant to safe participation in exercise
- Track measurements or progress when requested
- Respond to questions and support requests
- Process or document purchases and payments
- Administer packages, subscriptions, or training plans
- Maintain appropriate business records
- Operate and improve Fitness by Tara's services
- Protect the security and integrity of accounts and services
- Comply with applicable legal obligations
Fitness by Tara will not use progress photographs, videos, testimonials, or your likeness for public advertising or marketing solely because you provided them for training or progress-tracking purposes.
Separate permission will be requested before Fitness by Tara uses identifiable client photographs, videos, testimonials, or progress images for marketing or promotional purposes.
4. FITBUDD AND OTHER SERVICE PROVIDERS
Fitness by Tara uses third-party service providers to help operate its business and deliver Training Services.
These may include FitBudd for app-based fitness services and client management, scheduling providers, communications providers, payment processors, and other technology or business-service providers.
When you use these services, information may be collected, processed, transmitted, or stored by the applicable third-party provider according to its own systems, terms, and privacy practices.
Fitness by Tara does not control all security, storage, or processing practices of independent third-party service providers.
You should review the privacy information provided by applicable service providers if you would like additional information regarding their practices.
5. PAYMENTS
When electronic payments are processed through FitBudd or another third-party payment processor, payment information may be collected and processed by that provider.
Fitness by Tara may receive transaction-related information such as payment status, amount, date, purchased service or plan, and other information necessary to administer your account.
Fitness by Tara does not represent that it independently stores complete credit-card or debit-card numbers when those payments are processed directly by an independent payment provider.
6. INFORMATION SHARING
Fitness by Tara does not sell or rent client personal information to third parties for their independent marketing purposes.
Information may be shared when reasonably necessary:
- With service providers used to operate the business or provide Training Services
- With payment processors for payment transactions
- At your direction or with your consent
- When reasonably necessary to protect the safety, rights, or property of Fitness by Tara, a client, or another person
- When required by applicable law, court order, subpoena, or other lawful governmental request
- In connection with professional legal, accounting, insurance, or business-administration services when reasonably necessary
Service providers may have access to information only to the extent necessary for the services they provide and subject to their applicable privacy and security practices.
7. PHOTOS, VIDEOS & PROGRESS INFORMATION
Clients may choose to provide photographs, videos, measurements, or other progress information for fitness assessment and progress-tracking purposes.
Providing progress photographs is not authorization for Fitness by Tara to publicly post or use those photographs for advertising, social media, testimonials, or other promotional purposes.
Marketing use of identifiable client photographs, videos, testimonials, or likenesses requires separate authorization.
8. EMAIL & COMMUNICATIONS
Fitness by Tara may use the contact information you provide to communicate with you regarding appointments, training programs, account information, purchases, service announcements, questions, and other matters relating to your Training Services.
Fitness by Tara may also send occasional business or promotional communications where permitted by applicable law.
You may request to stop receiving non-essential promotional email communications by contacting Fitness by Tara. Service-related communications necessary to administer your training relationship may still be sent.
9. DATA SECURITY
Fitness by Tara takes reasonable steps appropriate to a small personal-training business to safeguard personal information within its control.
Third-party platforms and service providers may use their own technical and organizational security measures.
However, no electronic transmission, internet service, application, storage system, or method of communication can be guaranteed to be completely secure. Therefore, Fitness by Tara cannot guarantee absolute security of information transmitted or stored electronically.
10. DATA RETENTION
Fitness by Tara may retain client information for as long as reasonably necessary to provide Training Services, maintain legitimate business and transaction records, comply with legal or insurance obligations, resolve disputes, and protect legitimate business interests.
Retention periods may vary depending upon the type of information and the service provider through which it is stored.
11. ACCESSING OR CORRECTING YOUR INFORMATION
You may contact Fitness by Tara if you believe personal information maintained directly by Fitness by Tara is inaccurate or needs to be updated.
Certain account information may also be accessible or editable through FitBudd or other services used in connection with your account.
Requests concerning information controlled directly by an independent third-party service provider may need to be submitted to that provider.
12. THIRD-PARTY SERVICES
The Fitness by Tara app and related services may contain or use services, integrations, websites, or technology operated by third parties.
Those third parties may maintain their own privacy policies and terms. Fitness by Tara is not responsible for the independent privacy practices of third-party websites or services.
13. CHILDREN
Fitness by Tara's Training Services are intended for adults age 18 and older.
Fitness by Tara does not knowingly offer Training Services through the client platform to individuals under 18.
14. LEGAL DISCLOSURES
Fitness by Tara may disclose information when reasonably believed necessary to comply with applicable law, legal process, court orders, governmental requests, or to protect legal rights or safety.
15. CHANGES TO THIS PRIVACY POLICY
Fitness by Tara may update this Privacy Policy periodically to reflect changes in services, technology, business practices, or applicable requirements.
When appropriate, clients will be notified of material changes.
